Bhopal/Jabalpur: A division bench of
Madhya Pradesh high court has upheld the suspension of assistant commissioner, excise,
Satya Narayan Dubey overturning the single-judge bench order of the high court, which had set aside Dubey’s suspension order.
The state government had filed a revision petition against the order of the single-judge bench.
The division bench of Justice
Sujoy Paul and Justice D D Bansal while upholding the suspension order said that cancelling the suspension order on the ground that the act of irregularity for which the official was put under suspension has caused no financial damage to the excise department was not proper.
In the departmental enquiry being conducted against the official, it was prima facie found that the official could have been involved in illegal activities.
The departmental enquiry against the official is still on. The official, if restored to his previous position, could influence the enquiry. The court, therefore, upheld Dubey’s suspension order while conceding the appeal filed by the state government against the single-judge bench order.
